By reserving, accepting delivery of, signing for, or operating a vehicle provided by Bat City Rentals LLC, the renter acknowledges receiving these Terms and agrees that they are incorporated into the signed Rental Agreement. The signed Agreement and this page are intended to contain the same substantive terms. Rental-specific entries in the signed Agreement control for that rental.
Important: Section 17 explains roadside assistance and breakdown responsibilities. Section 23 contains binding arbitration, a jury-trial waiver, a class-action waiver, and a 30-day opt-out right.
1. Rental Information
The rental-specific information is completed in the signed Agreement or reservation record, including the renter, authorized drivers, vehicle, VIN, license plate, dates, rate, deposit, mileage, insurance selection, and any approved addendum.

- Additional mileage: $0.38 per mile

- Fuel return fee: $25.00 plus fuel when applicable
2. Vehicle Condition & Inspection
Renter acknowledges inspection of the vehicle before the rental and accepts the vehicle in its present condition, except as documented on the Vehicle Inspection Report in Section 27. Before and after each rental, the vehicle undergoes a comprehensive inspection, including photographic documentation, which verifies the vehicle condition, mileage, and fuel level and becomes part of the permanent rental record. Renter agrees to return the vehicle in substantially the same condition, ordinary wear and tear excepted.
3. Authorized Drivers
Only drivers specifically listed on this Agreement are authorized to operate the vehicle. All operators must maintain a valid driver's license and satisfy all applicable legal and insurance requirements. Bat City Rentals LLC reserves the right to perform a background check on the primary renter and any additional drivers. Adding an authorized driver may be subject to a one-time fee or daily surcharge. Any operation by an unauthorized driver constitutes a material breach of this Agreement.
4. Insurance Requirements
Renter shall either: (A) maintain valid full-coverage automobile insurance extending to rental vehicles, with a deductible of no more than $500.00; or (B) purchase optional coverage offered by Bat City Rentals LLC. Proof of insurance may be required before vehicle release. For long-term rentals, Bat City Rentals LLC must be named as lienholder on Renter's insurance policy. Regardless of insurance selection, Renter remains financially responsible for deductibles, excluded losses, prohibited-use damages, administrative fees, and towing, storage, loss-of-use, diminished-value, roadside, or recovery charges when chargeable to Renter under this Agreement or applicable law.
5. Prohibited Uses
The vehicle shall not be used for Uber, Lyft, DoorDash, Uber Eats, Grubhub, Instacart, Spark, Amazon Flex, or other commercial delivery or rideshare services; racing or speed contests; off-road operation; towing; illegal activity; transport of hazardous materials; operation under the influence of drugs or alcohol; operation by unauthorized drivers; operation outside the State of Texas without prior written approval; or operation outside the United States, including entry into Mexico. Violation of this Section constitutes a material breach and may void any optional coverage.
6. Accidents, Theft, and Damage
In the event of an accident, theft, or damage, Renter shall immediately contact law enforcement if required and obtain a police report; notify Bat City Rentals LLC; obtain names, addresses, insurance information, and witness information; and cooperate fully with insurance investigations. Renter may not authorize repairs without prior written approval from Bat City Rentals LLC, except for temporary emergency measures strictly necessary to protect occupants or prevent additional immediate damage. Renter must notify Bat City Rentals LLC as soon as safely possible. Failure to comply may constitute a material breach of this Agreement.
7. Damage Responsibility
Renter is responsible for damage sustained during the rental period when caused by Renter, an authorized or unauthorized driver, misuse, negligence, a prohibited use, or another breach of this Agreement. Chargeable losses may include damage to tires, wheels, rims, glass, body, mechanical components, and interior; lost keys; missing accessories; theft or vandalism losses; towing and storage fees; and reasonable administrative costs.
8. Loss of Use
If the vehicle becomes unavailable because of damage chargeable to Renter under this Agreement, Renter agrees to pay reasonable loss-of-use damages for the time reasonably necessary to inspect and repair the vehicle, to the extent permitted by applicable law.
9. Diminished Value
To the extent permitted by Texas law, Renter is responsible for diminished value resulting from damage chargeable to Renter under this Agreement.
10. Mileage & Fuel Policy
Standard rentals include an allowance of 200 miles per rental day unless otherwise stated in Section 1. Mileage exceeding this allowance is billed at $0.38 per mile. The vehicle must be returned with the same fuel level recorded at the start of the rental; any fuel deficiency will be assessed at the current replacement cost plus a $25.00 refueling service fee.
11. Tolls, Tickets, and Fines
Renter is responsible for all tolls, parking citations, traffic citations, impound charges, towing fees, and storage fees incurred during or arising from the rental period. Bat City Rentals LLC may charge the payment method on file for such amounts, plus an administrative processing fee of $25.00 per occurrence.
12. Payment Authorization
Renter authorizes Bat City Rentals LLC to charge all payment methods provided for rental charges, extensions, mileage charges, fuel charges, damage claims, roadside assistance, towing, recovery, tolls, citations, cleaning fees, administrative fees, collection expenses, and other amounts lawfully owed under this Agreement.
13. Cleaning Fees
Smoking or vaping is prohibited. The Smoking/Vaping Fee is $250.00. Excessive Cleaning may be charged up to $300.00. Biohazard Cleanup is charged at the actual documented cost.
14. Vehicle Delivery
If delivery service is selected, the delivery fee starts at $60.00 and covers drop-off and retrieval of the vehicle only. This fee does not include tolls, parking fees, or traffic or parking citations incurred during delivery or retrieval.
15. GPS Disclosure
Renter acknowledges that the vehicle may be equipped with GPS tracking devices and telematics systems, which may be used for vehicle recovery, theft prevention, emergency location support, maintenance monitoring, mileage verification, and contract compliance. Tampering with or disabling GPS equipment will result in a $150.00 fee.
16. Remote Immobilization
Renter acknowledges and agrees that the vehicle is equipped with a remote tracking and immobilization system. The vehicle may be remotely immobilized for purposes of theft recovery, vehicle repossession, or upon any material breach of this Agreement. For safety, immobilization will only be initiated while the vehicle is stationary with the engine turned off, and never while the vehicle is in motion. If the vehicle is not returned by the scheduled time and the payment method on file cannot be successfully charged, an additional rental day will be charged two (2) hours past the scheduled return time, and the vehicle may be subject to immediate remote immobilization. To reactivate the vehicle, Renter must settle all outstanding balances in full, plus a $25.00 reactivation fee. If physical recovery of the vehicle becomes necessary, Renter shall be responsible for all actual recovery costs, towing fees, and associated expenses.
17. Roadside Assistance & Breakdowns
A. No Roadside Assistance Plan Included: Bat City Rentals LLC does not provide or include a roadside assistance plan and does not sponsor or automatically cover third-party roadside, towing, or breakdown services. Renter must immediately notify Bat City Rentals LLC of any flat tire, tire blowout, dead battery, lockout, lost key, mechanical warning, breakdown, or other operational issue. Except as provided in subsection D or required by applicable law, Renter is responsible for arranging and initially paying for roadside service, towing, or recovery. Renter may use a personal roadside provider, including AAA or roadside coverage supplied by an insurer, at Renter's expense.
B. Renter Financial Responsibility: Renter is responsible for all call-out fees, labor, towing charges, recovery charges, and repair or replacement costs arising from Renter's acts, omissions, misuse, negligence, prohibited use, off-road operation, or breach of this Agreement. This includes repairing or replacing damaged tires, wheels, or rims; battery jump-starts or replacement when the discharge or damage was caused by Renter; lockout service, lost-key service, or remote-key replacement; and extrication or winching if the vehicle becomes stuck or is driven off-road.
C. Prior Written Authorization Required for Repairs: Renter shall not authorize physical repairs, mechanical work, tire replacement, parts replacement, or permanent alteration of the vehicle without first obtaining express written consent from Bat City Rentals LLC. Temporary emergency measures strictly necessary to protect occupants or prevent immediate additional damage are permitted only when prior contact is not reasonably possible, and Renter must notify Bat City Rentals LLC as soon as safely possible. Replacement tires must match the vehicle's original specifications and comparable brand quality unless otherwise approved in writing. Unauthorized repairs may be denied reimbursement, charged to Renter, and treated as a material breach.
D. Ordinary Mechanical Breakdown Not Caused by Renter: Renter is not responsible for the cost of repairing a pre-existing defect or ordinary mechanical failure that was not caused or worsened by Renter, an authorized or unauthorized driver, misuse, negligence, prohibited use, or breach of this Agreement. Bat City Rentals LLC will determine and authorize the appropriate towing, inspection, repair, or replacement-vehicle response. Incidental expenses, delay costs, lodging, transportation, or lost time are not reimbursable unless Bat City Rentals LLC agrees in writing or reimbursement is required by applicable law.
18. Vehicle Recovery
If the vehicle is abandoned, unlawfully retained, or obtained by fraud, Bat City Rentals LLC may exercise all lawful recovery rights available under Texas law.
19. Indemnification
Renter agrees to defend, indemnify, and hold harmless Bat City Rentals LLC from claims, losses, liabilities, damages, costs, and reasonable attorney fees arising from Renter's possession or operation of the vehicle, except to the extent caused by Bat City Rentals LLC's own unlawful conduct or as otherwise prohibited by applicable law.
20. Limitation of Liability
To the maximum extent permitted by applicable law, Bat City Rentals LLC disclaims liability for indirect, incidental, special, or consequential damages arising from the use, unavailability, breakdown, or operation of a rental vehicle.
21. Deposit, Refunds & Collections
The security deposit identified in Section 1 may be applied by Bat City Rentals LLC to satisfy unpaid rental charges, damages, fuel costs, cleaning fees, tolls, citations, excess mileage, roadside or towing charges, missing equipment, or any other amount lawfully owed under this Agreement. Any remaining balance will be returned to the original form of payment within 5-10 business days, subject to the Renter's financial institution's processing times. Early returns do not automatically entitle Renter to a refund. Reservation cancellations may be subject to cancellation fees depending on the timing of cancellation.
Any amount not paid when due may be referred for collection. To the extent permitted by applicable law, unpaid balances will accrue simple interest at the lesser of eighteen percent (18%) per annum or the maximum lawful rate. Renter agrees to pay reasonable costs incurred to collect amounts lawfully owed under this Agreement, including collection agency fees, court costs, filing and service fees, skip-tracing expenses, and reasonable attorney fees when recoverable by contract or law. Payments will be applied first to lawful collection costs and accrued interest, then to principal. These obligations survive the end of the rental and return of the vehicle.
22. Electronic Communications & Signatures
By entering into this Agreement, Renter consents to receive communications from Bat City Rentals LLC by email, SMS, or phone regarding reservations, vehicle status, safety alerts, payment issues, and rental administration. Electronic signatures and records shall be considered valid and enforceable.
23. Arbitration
Any dispute, claim, controversy, or cause of action arising out of or relating to this Agreement, the vehicle rental, or services provided by Bat City Rentals LLC shall be resolved exclusively through final and binding arbitration in the Texas county where the vehicle was rented, unless the parties mutually agree otherwise. Both parties waive the right to a trial by judge or jury.
Governing Rules: This Agreement involves interstate commerce and is governed by the Federal Arbitration Act, 9 U.S.C. Section 1 et seq. To the extent state law applies, the laws of the State of Texas shall govern. Arbitration shall be administered by the American Arbitration Association under its Consumer Arbitration Rules. Filing, administration, and arbitrator fees are governed by the AAA Consumer Rules, and each party shall bear its own attorney fees, expert witness fees, and legal costs unless otherwise required by applicable law.
Class Action Waiver: Each party may bring claims against the other only in an individual capacity and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding.
Small Claims Exception: Either party may bring an individual action in a Texas Justice of the Peace Court if the dispute falls within applicable jurisdictional limits.
Right to Opt Out: Renter may opt out of this arbitration agreement by notifying Bat City Rentals LLC in writing within thirty (30) days of signing this Agreement. Notice must be sent by certified mail to Bat City Rentals LLC, PO Box 271, Del Valle, TX 78617, Attn: Legal Department.
Severability: If any provision of this arbitration section is found invalid, that portion shall be severed and the remaining provisions shall remain in effect.
24. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Texas.
25. Full Terms & Conditions
This Agreement incorporates by reference the complete Bat City Rentals LLC Terms & Conditions of Vehicle Rental set forth in this Agreement and available online at batcityrentals.com/rental-terms.html. The online version and signed version are intended to contain the same substantive terms. Renter should review the online Terms & Conditions in full. In the event of a conflict between the rental-specific terms of the signed Agreement and the online Terms & Conditions, the signed Agreement controls for that rental.

27. Vehicle Inspection Report
The signed Agreement records mileage, fuel level, and damage notes at pickup and return. Photographs and related inspection records are incorporated into the permanent rental record.
